The terms and conditions define the rules for entering into sales agreements via the Famoushoteliers.net store.

DEFINITIONS

  1. Famoushoteliers.net refers to the online store that sells books and e-books, operated by the company Woliński & Hotel, located in Poland at Leszczyńskiego 11/6, Elbląg, 82-300, VAT ID 5781553899, REGON 171014890, email address: info@famoushoteliers.net

  2. A book is a publication containing written content and available in printed format.

  3. An e-book means a book saved in the form of a file (digital content) available on the famoushoteliers.net website in formats: epub and mobi, not protected by DRM, and marked with a watermark.

  4. Buyer refers to a natural person, a legal entity, and an organizational unit without legal personality.

  5. Electronic device refers to a device designed, among others, for downloading and storing digital files (e.g., a personal computer, smartphone, tablet, e-book reader).

  6. The sale of e-books means the paid provision of access to an e-book by Famoushoteliers.net at the Buyer's request, enabling the Buyer to use the e-book without time restrictions exclusively through electronic devices – in accordance with the provisions specified in these Regulations.

  7. Online payment service provider refers to entities that are payment institutions, with which Famoushoteliers.net cooperates in handling payments for the sale of books or e-books, i.e.:

  • PayPal (Europe) S.à r.l. & Cie, S.C.A with headquarters at L-1150 in Luxembourg.
  1. Payment for the order means the act of charging the Buyer's bank account or credit card an amount specified in the order, confirmed by the Online Payment Service Provider or bank.

ORDER FULFILLMENT

  1. Making a purchase on the famoushoteliers.net site is voluntary and does not require creating an account.

  2. Placing an order requires filling out the order form, accepting the terms and conditions and the privacy policy, and making a payment.

  3. The Buyer makes payment for the order according to the method chosen by themselves through the Online Payment Service Provider, using available payment methods.

I. Ebooks

  1. Each e-book offered on the Famoushoteliers.net website includes information specifying the characteristics, size, and format (epub, mobi) of the file. Before making a purchase, the Buyer should check whether the electronic device intended for downloading the e-book meets the requirements for using the purchased e-book.

  2. All prices listed on the Famoushoteliers.net website are in EUR and include VAT (value-added tax).

  3. After payment confirmation, a contract is concluded, the subject of which is the sale of the e-book. Then, the Buyer receives payment confirmation from the Online Payment Service Provider to their email address.

  4. After recording the payment for the order, the Buyer is granted access to the ordered e-book in the selected format, i.e., epub or mobi, through an email sent to the address provided by the Buyer containing a link to the website from which the e-book can be downloaded. The buyer can download the ebook only once and has 7 days to do so. On the next attempt or after 7 days, the download link for the ebook will no longer be active.

  5. In the email with the link to the e-book, the Buyer receives details of the paid order, instruction about the loss of the right to withdraw from the contract within 14 days due to the request to start the service, and information about the rights arising from the concluded contract for delivering online files.

  6. Downloading the e-book automatically excludes the right to withdraw from the contract according to the rules specified in the section on withdrawing from the contract.

II. Books

  1. The famoushoteliers.net store conducts direct sales of books exclusively in Polish, and their delivery is carried out only within Poland.

  2. For books printed in Polish, prices in PLN apply, to which shipping costs are added, depending on the chosen form of delivery, i.e.:

  • Inpost parcel locker – 14 PLN gross
  • Inpost courier – 18 PLN gross
  1. Shipping abroad is possible after individual agreement on costs.

  2. The shipment of printed books is carried out within 2 business days from the recording of the payment. Order confirmation and details regarding shipping are sent to the Buyer's email address.

  3. Books in languages other than Polish are sold exclusively through the Amazon platform, where separate terms and conditions of sale apply. The famoushoteliers.net website only includes basic information about the book and a link to the product on Amazon.

  4. The books presented on famoushoteliers.net and their prices are purely informational and do not constitute a commercial offer within the meaning of Article 66 §1 of the Civil Code.

  5. The prices of books available on Amazon.com may differ from the prices presented on famoushoteliers.net. Amazon conducts its own pricing policy, introducing, for example, seasonal promotions or other special offers, over which famoushoteliers.net has no influence.

  1. At the Buyer's request expressed by marking the appropriate field in the order form and providing the necessary data, Famoushoteliers.net issues an electronic invoice and sends it to the Buyer's email address within 48 hours.

USING THE E-BOOK

  1. The Buyer who has purchased an e-book can download the file in the purchased format, i.e., epub or mobi. Additionally, they can save and display it on any Electronic Device chosen by the Buyer, without time restrictions.

  2. The sale of the e-book allows the Buyer to use the e-book exclusively for personal use. The sale of the e-book does not constitute a transfer of rights or the granting of a license to the content of the e-book. Recording, copying, and distributing the e-book in a manner other than specified in these Terms of Use requires written consent from the copyright holder.

  3. E-books in all formats are protected against unauthorized use—by watermarks—through a copyright protection system that registers a unique transaction identification number on the files, enabling verification of who has acquired the rights to the e-book.

WITHDRAWAL FROM THE AGREEMENT - EBOOK

  1. The Buyer has the right to withdraw from the purchase up until payment for the e-book.

  2. The right to withdraw from the contract without giving a reason within 14 days of receiving the goods does not apply to digital content not stored on a tangible medium (e-books). If purchased according to the following rules: a) The Buyer agrees to the commencement of the service consisting of delivering digital content (e-books) before the end of the withdrawal period. b) Famoushoteliers.net informs the Buyer about the loss of the right to withdraw from the contract.

  3. The Buyer loses the right to withdraw from the contract at the moment the e-book file is made available for download in such a way that the Buyer can save the e-book on their electronic device.

WITHDRAWAL FROM THE AGREEMENT – PRINTED BOOK

  1. The Buyer who is a Consumer has the right to withdraw from the sales contract within 14 calendar days without giving any reason (i.e., return of the goods). To comply with the deadline, it is sufficient to send a statement before its expiry. The statement of withdrawal from the contract can be made in the following ways: a) in writing to the address: WOLIŃSKI & HOTEL ul. Leszczyńskiego 11/6, 82-300 Elbląg; b) electronically via email to the address: info@famoushoteliers.net;

  2. The Buyer may formulate the statement independently or use the template of the statement of withdrawal from the Agreement, available HERE.

  3. The 14-day period counts from the day on which the book was delivered, and its return should be made to the store's address.

  4. The Buyer bears the direct costs of returning the book.

  5. In the event of withdrawal from the sales contract, famoushoteliers.net returns to the Buyer all payments received, including the costs of delivering the goods to (excluding additional costs resulting from the Buyer's choice of a delivery method other than the cheapest standard delivery method offered by the store), no later than 14 days from the day on which the store was informed about the Buyer's decision to exercise the right of withdrawal from the sales contract.

  6. The Buyer is responsible for any decrease in the value of the book resulting from its use in a manner other than was necessary to establish the nature, characteristics, and functioning of the book.

COMPLAINTS

  1. The Buyer may file a complaint regarding defects and faults in e-books or books. Complaints should be submitted via email to the address info@famoushoteliers.net

  2. The complaint will be considered within 14 days of its receipt. The Buyer will be informed about the result of the complaint consideration via email to the email address used to submit the complaint.

PROCESSING PERSONAL DATA

  1. In order to conclude and execute sales contracts, as well as to perform the seller's obligations resulting from the conclusion of distance sales contracts, famoushoteliers.net processes the personal data of the Buyer, the provision of which is voluntary. All information regarding the processing of personal data can be found in the Privacy Policy tab.

FINAL PROVISIONS

  1. These Regulations are available on the Famoushoteliers.net website. It can also be sent to the Buyer in electronic form at their request to the specified email address.
